Methodology: presentation of videos and messages in text and image that simplify the way of learning about the topics, explanation of the legal foundations versus artificial intelligence (AI) under clear language and a forceful approach to being solid, harmonious, and universal, carrying out reflections and debates with the attendees, correlation and, consequently, permanent feedback, and development of a simulation on the topic of the course so that students are effectively trained in this field. With this, students understand and can apply the (universal) foundations of law – legal foundations – in any matter (preventive – permanent legal support, advice, consultancy, audit, regulatory approach, self-regulation formulas, good legal practices, etc. – or corrective – litigation, alternative dispute resolution, control in the event of non-compliance with the law by the public or private sector, evidentiary analysis, opinions, appeals against judicial or administrative decisions, etc. -) related to artificial intelligence (AI) that they handle as lawyers.

Agenda:

  1. Foundations of law in legal theory in general concerning AI ( legal epistemology in general, legal methodology in general, defined philosophy in law – including a coherent relationship between morality and law, between norm and law and between justice and law -, interpretation, application, compliance, contextualization, foundation of law, evolution of law and specific legal details in the face of artificial intelligence, AI ).
  2. Legal foundations of AI in civil matters ( diligence, validity, effectiveness, and legal certainty, content and effect of the law, good faith, negligence and fraud, general diligence, enjoyment of rights and fulfillment of duties in legal relationships, and legal qualification before AI ).
  3. Legal foundations of AI in commercial and business matters ( commercial diligence, valid profit motive, contractual relations, non-contractual relations, interest groups, corporate governance, commercial operations, and commercial activities, freedom and limits in business development, legal management of the commercial company, and modern business management in the face of AI ).
  4. Legal foundations of AI in the administrative field ( prevalence of the general interest, validity of the particular interest, rule of law, administrative acts, administrative processes, and procedures, administrative decisions, control of administrative actions, effectiveness of rights and duties in public administration and vis-à-vis the public administration, freedom and limits in public management and modernization of public administration in the face of AI ).
  5. Legal foundations of AI in the constitutional field ( clarity of the existence or non-existence of prevalences, prioritization, and hierarchies between rights and duties, the constitutional and the rest of the law, legal systematization about constitutional and non-constitutional norms, the constitutional in general and at a special level about the specific case and constitutional effectiveness in the face of AI ).
  6. Legal foundations in the labor field ( valid labor relations, protection, favorability, freedom and limits in labor development and modern labor management in the face of AI ).
  7. The legal foundations of AI in criminal law ( legal precision, impunity, punishment, exoneration, and the non-existence of criminal liability in the face of AI ).
  8. The legal foundations of AI in procedural matters ( effectiveness, validity, and legal certainty of judicial processes and procedures, including arbitration, of the actions of defenders and those represented, and of the development of alternative dispute resolution methods using AI ).
  9. Legal foundations of AI in international affairs ( legal criteria of national, foreign, and international affairs, effectiveness of rights and duties in international affairs, and harmonious development of international legal relations in the face of AI ).
  10. Role play ( where students apply legal fundamentals about an imaginary artificial intelligence, AI, and the teacher gives them feedback ).
